Terms of Service

These Terms of Service (“Terms”) govern your use of the website and services operated by Visupair at visupair.com. By using the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site.

1. What Visupair offers

Visupair is a creative studio and online store. You may use the site to browse Visupair’s work, buy physical and digital products, request creative services, and manage your account. Details about deliverables, timelines, and revisions appear on the relevant product or service page or in messages between you and Visupair.

2. Accounts

• Some features require an account (for example purchases, downloads, or favorites).
• You may be able to sign in with email and password or through a third-party account (such as social sign-in). That provider’s terms and privacy notice apply to the sign-in step.
• Keep your login details confidential and notify Visupair promptly at info@visupair.com if you suspect unauthorized use. You are responsible for activity under your account until you do so, within reason.
• Visupair may suspend or close an account if Visupair reasonably believes there is abuse, fraud, or material risk to the site or other users.

3. Orders, prices, and payment

• Visupair aims for accurate descriptions and prices. Visupair may refuse or cancel orders that are clearly mistaken (including obvious pricing errors). If Visupair cancels after you have paid, Visupair will refund you as described in the Refund Policy.
• Payments are handled by an independent payment provider. Visupair does not store your full card number on its systems; payment data is protected according to that provider’s practices and terms.
• You authorize Visupair (and the payment provider, as needed) to charge your selected method for the amounts shown at checkout, including applicable taxes and shipping where Visupair states them.

4. Digital and physical products

• Digital products are licensed as described on the product page. Unless Visupair states otherwise, you receive a non-exclusive license for use described there—for example personal or agreed commercial use. You may not resell, redistribute, or share files in a way that replaces buying from Visupair, or strip credits, watermarks, or license notices where Visupair includes them.
• Physical products depend on availability, production, and shipping shown at checkout or on the product page. Risk of loss in transit follows the carrier’s terms unless mandatory law says otherwise.

5. Custom services

Commissioned or packaged services follow the scope, revisions, and fees on the service page or in a written agreement. You provide materials and feedback on time; your delays may shift delivery dates. Visupair keeps general methods and pre-existing know-how; you receive the deliverables Visupair agrees for your order unless the contract says otherwise.

6. Acceptable use

You agree not to:

• Violate applicable law, infringe others’ rights, or misuse Visupair’s content, branding, or systems.
• Interfere with the site or other users (for example by hacking, scraping, or trying to overwhelm Visupair’s infrastructure).
• Use Visupair’s products or services to create unlawful, harassing, or deliberately misleading work.

7. Other providers

Like most online businesses, Visupair uses independent suppliers for payment, authentication, hosting, and related tasks. Those arrangements do not change these Terms. What personal data is processed, why, and your rights are set out in the Privacy Policy and Cookie Policy. Visupair is not liable for events caused solely by a supplier outside Visupair’s reasonable control, and Visupair does not guarantee uninterrupted service.

8. Intellectual property

Content on the site (including art, text, branding, and layout) belongs to Visupair or Visupair’s licensors unless marked otherwise. These Terms only grant the rights Visupair spells out (including digital licenses in section 4).

9. Warranty and liability

• Visupair provides the site and products “as is,” to the extent the law allows. Visupair does not promise error-free or uninterrupted operation.
• Nothing here limits liability that cannot be limited under applicable law (including certain consumer rights in the EU, EEA, or UK).
• Except where the law forbids, Visupair is not liable for indirect damages, lost profits, or lost data. For a claim tied to a specific paid order, Visupair’s liability is generally limited to what you paid for that order.

10. Refunds

Refunds and cancellations follow the Refund Policy. If you are a consumer, statutory rights in your country may still apply—for digital content, withdrawal can be limited once delivery or performance has started with your consent, where the law allows.

11. Changes

Visupair may update these Terms by posting a new version and changing the date above. Where changes are material, Visupair may also notify you on the site or by email if Visupair has your address. Continued use after the effective date means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Poland (without regard to conflict-of-law rules), while mandatory consumer protections in your country of residence (for example in the EU, EEA, or UK) remain available where the law requires. Competent courts are generally those for Visupair’s place of business, subject to those consumer rules.
